TERMS AND CONDITIONS

These general conditions concern the purchase of products, carried out remotely via the vibivenezia.it website owned by VAVG Venezia Srl, with registered office in Via Cernaia 6, 20121 Milan.
Purchase operations will be governed by the Consumer Code Legislative Decree no. 206/2005, while privacy protection will be subject to Legislative Decree 196/03.

For companies that require an invoice, it is necessary to have a VAT number and fill in all the required fields.

ACCEPTANCE OF THE TERMS OF SALEThe conditions outlined in the preamble are an integral and essential part of this contract.
All contracts will be concluded directly by the consumer customer accessing the website at the address vibivenezia.it, where the customer can, in fact, conclude the contract for the purchase of the desired product by carefully following the instructions and procedures provided.
These general conditions of sale must be examined "online" by the customer before completing the purchase procedure. The submission of the order confirmation therefore implies full knowledge of them and their full acceptance.

In accordance with article 66 bis of Legislative Decree 206/2005, the competent court will be that of the consumer's residence or domicile if located in Italian territory.

SALES PRICES AND PURCHASE METHODSThe sales prices indicated on the vibivenezia.it website are always expressed in €uro and include VAT.
All prices do not include shipping costs or any additional costs.
The total shipping cost will be communicated to the customer before confirming the purchase.
The purchase contract is perfected by the exact compilation and the consent to the purchase expressed through the "online" adhesion. The customer can pay for the ordered goods using the payment methods indicated "online" at the time of purchase.

DELIVERYThe company VAVG Venezia Srl, owner of the vibivenezia.it website, will deliver the selected and ordered products to customers, at the address indicated by the customer, using the methods provided for in the previous article, by couriers.

The risk of damage and loss of the goods is always borne by VAVG Venezia Srl during shipping and transport, and is transferred to the consumer only when the latter – or a third party designated by him and different from the carrier – physically takes possession of the goods. The only exception, established by art. 63 of Legislative Decree 206/2005, is the case in which the carrier was chosen by the consumer from outside those offered by VAVG Venezia Srl: in this hypothesis, the risk is transferred to the consumer already at the time of delivery of the goods to the carrier.

RESPONSIBILITYThe company VAVG Venezia Srl does not assume responsibility for disruptions attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, the execution of the contract within the agreed times.

The company VAVG Venezia Srl is not responsible for any fraudulent and illicit use that may be made by third parties of credit cards, checks and other means of payment, at the time of payment for the purchased products. The company VAVG Venezia Srl, in fact, at no time during the purchase procedure is able to know the credit card number of the buyer who, through a protected connection, is transmitted directly to the banking service provider.

BUYER'S OBLIGATIONSIt is strictly forbidden for the buyer to enter false, and/or invented, and/or fictitious data in the registration procedure necessary to activate the process for the execution of this contract and the related further communications.
The Customer indemnifies the company VAVG Venezia Srl from any responsibility deriving from the issuance of incorrect tax documents due to errors relating to the data provided by the Customer, the Customer himself being solely responsible for the correct entry.

RIGHT OF WITHDRAWALThe customer can exercise the right of withdrawal, returning the goods received and obtaining a refund of the price paid. Check the conditions for the right of withdrawal.

LEGAL GUARANTEEIn addition to the VAVG Venezia Srl guarantee, as indicated on the packaging of each product, a legal guarantee of conformity of 24 months from the delivery of the product is provided, as foreseen by the Consumer Code in articles 128 -135.

DISPUTE RESOLUTIONConsumers residing in Europe are informed that the European Commission has established an online platform that provides an alternative dispute resolution tool.
This tool can be used by European consumers to resolve out-of-court any dispute relating to online sales contracts for goods and services and/or deriving from them.
Consequently, if you are a Consumer established in Europe, you can use this platform to resolve any dispute arising from the online contract stipulated on this site.
